These Terms & Conditions ("Terms") govern your use of this website and any donation you make to World Water Solutions ("WWS," "we," "us," or "our"), a Native-led 501(c)(3) nonprofit organization. By using this site or making a donation, you agree to these Terms. If you do not agree, please do not use this site or make a donation.

1. Voluntary Donations

All donations to WWS are voluntary. Making a donation does not entitle you to any goods, services, ownership interest, or control over how funds are used. WWS retains full discretion over the use of all donated funds in furtherance of its charitable mission, consistent with applicable law.

2. Donor Representations & Affirmations

By making a donation, you represent, warrant, and affirm that:

• The funds you are donating are legitimate and lawfully obtained, and are not derived from, or connected to, any unlawful activity, money laundering, fraud, or the financing of any illegal purpose;
• You are the lawful owner of the funds (or are authorized to donate them) and have the legal right and capacity to make the donation;
• You are at least 18 years of age;
• Your donation does not violate any applicable law, regulation, sanctions program, or the terms of any third party;
• All information you provide in connection with your donation is accurate and complete.

3. Limitation of Liability

To the fullest extent permitted by applicable law, World Water Solutions and its officers, directors, employees, agents, and volunteers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of funds, profits, or data, arising out of or relating to your donation, your use of this website, the conduct of any third-party payment processor, or these Terms — whether based in contract, tort, or any other legal theory, and even if advised of the possibility of such damages.

4. Release & Indemnification

You release and agree to hold harmless, defend, and indemnify World Water Solutions and its officers, directors, employees, agents, and volunteers from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your donation, your breach of these Terms, or any of your representations being untrue.

5. Refund Policy

Donations are generally non-refundable. If you believe a donation was made in error, contact us promptly at info@worldwatersolution.org and we will review the request in good faith; refunds, if any, are at our sole discretion and subject to the policies of the relevant payment processor.

6. Tax Deductibility

World Water Solutions is a 501(c)(3) tax-exempt organization (EIN: 39-4084224). Donations may be tax-deductible to the extent permitted by law; no goods or services are provided in exchange for a donation unless otherwise stated. We do not provide tax or legal advice — please consult your own advisor regarding the deductibility of your contribution.

7. Third-Party Payment Processors

Donations are processed by third-party providers — including Zeffy (card and bank payments) and NowPayments (cryptocurrency). Your use of these processors is subject to their own terms and privacy policies. WWS does not control and is not responsible for the acts, omissions, availability, security, or errors of any third-party processor.

8. Cryptocurrency Donations

Cryptocurrency donations are irreversible and their value may fluctuate. You are solely responsible for ensuring you send the correct asset to the correct address and for any tax reporting related to your crypto donation. WWS is not responsible for losses resulting from network errors, incorrect transfers, or market volatility.

9. Privacy

Information you provide when donating is used to process your gift, issue acknowledgments, and (with your consent) send updates about our work. We do not sell your personal information. Payment details are handled by our payment processors and are not stored by WWS.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Your continued use of the site or any new donation constitutes acceptance of the then-current Terms.

11. Governing Law

These Terms are governed by the laws of the State of Hawai'i, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hawai'i.
